1. Acceptance of Terms
- By creating an account or using abcAssess, you agree to be bound by these Terms of Service.
- If you do not agree, you may not use the application.
2. Eligibility and Authority
- You are an authorized representative of a school or educational institution.
- You have the legal authority to enter student data into this application in accordance with your local school district’s policies and national laws (such as FERPA or GDPR).
3. Intellectual Property
- Ownership: All software, code, designs, graphics, and branding (including the name “abcAssess”) are the exclusive property of Danielle Andrist/abcAssess and are protected by copyright laws.
- License: We grant you a limited, non-exclusive, non-transferable license to use the app for educational purposes. You may not reverse-engineer, copy, or redistribute the source code.
4. User Responsibilities and Prohibited Use
You agree not to:
- Store highly sensitive PII (Personally Identifiable Information) such as Social Security numbers or full medical records.
- Attempt to bypass the application’s security or encryption layers.
- Share your account credentials with unauthorized users.
- Use the app for any illegal or unauthorized purpose.
5. Limitation of Liability
abcAssess is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law:
- We do not guarantee that the service will be uninterrupted or error-free.
- We are not liable for any data loss, inaccuracies in assessment results, or any disciplinary actions taken by your school or district resulting from the use of this app.
- Our total liability for any claim arising from your use of the app is limited to the amount you paid us (if any) to use the service.
6. Termination of Service
- By You: You may terminate your account at any time. Upon termination, we will perform a Cascade Delete of all your associated data as outlined in our Privacy Policy.
- By Us: We reserve the right to suspend or terminate your account if you violate these terms or if the service is discontinued.
7. Changes to Terms
We may update these terms from time to time.
- We will notify you of significant changes via the email address associated with your account.
- Continued use of the app after such changes constitutes acceptance of the new terms.
8. Governing Law
These terms are governed by the laws of North Dakota/USA without regard to its conflict of law principles.
